Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, products, services, and content provided by Master Your Trading Mindset (“MYTM”), operated by Telos Holdings Pty Ltd (ABN 22 687 704 936), including all associated platforms, courses, mentorship programs, community spaces, tools, and communications.

By accessing or using any MYTM product or service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use MYTM’s products or services.

1. Definitions

• “MYTM” refers to Master Your Trading Mindset, Telos Holdings Pty Ltd (ABN 22 687 704 936), Bailouni Enterprises (ABN 49 419 296 048), Patrick Bailouni (in his personal capacity and as content creator), and all associated directors, officers, employees, contractors, affiliates, and agents.
• “Services” refers to all products, courses, mentorship programs, community access, live calls, tools (including TELA-X), YouTube videos, social media content, podcasts, and any other content or offerings provided by MYTM, Telos Holdings Pty Ltd, Bailouni Enterprises, or Patrick Bailouni across any platform or medium.
• “User,” “You,” “Your” refers to any individual accessing or using any MYTM Service.
• “Content” refers to all text, video, audio, images, data, strategies, frameworks, and other materials provided through the Services.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use MYTM’s Services. By using our Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

3. Nature of Services

You acknowledge and agree that:

• All trading decisions are yours alone and made at your own risk
• MYTM has no obligation to update or correct any Content
• Market analysis, trade breakdowns, and strategy discussions are educational illustrations, not trade recommendations
• No Content should be interpreted as a promise of specific results or financial outcomes

4. Account & Access

When you purchase or register for a Service, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify MYTM immediately of any unauthorised use.

Your access to the Services is personal and non-transferable. You may not share, sell, lend, or distribute your login credentials or access to any other person. MYTM reserves the right to terminate or suspend access for any account believed to be shared or misused.

5. Payment & Pricing

All prices are listed in US Dollars (USD) unless otherwise stated. Payment is due at the time of purchase. By completing a purchase, you authorise MYTM to charge the specified amount to your chosen payment method.

For subscription-based Services (if applicable), you authorise recurring charges at the stated interval until you cancel. You may cancel at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.

MYTM reserves the right to change pricing at any time. Price changes do not apply retroactively to existing purchases. Promotional or discounted pricing is valid only during the stated promotional period.

6. Refund Policy

Refunds are subject to MYTM’s Refund Policy. By purchasing, you acknowledge that you have read and agreed to the refund terms prior to completing your transaction.

7. Intellectual Property

All Content, materials, trademarks, logos, designs, course structures, methodologies, frameworks (including the MYTM methodology, BPM framework, and all associated intellectual property), software, and other proprietary materials are owned by or licensed to MYTM and are protected by Australian and international copyright, trademark, and intellectual property laws.

You may not:

• Copy, reproduce, distribute, publish, or share any Content without prior written consent
• Record, screenshot, screen-capture, or otherwise capture live calls, course content, or community discussions
• Modify, adapt, translate, or create derivative works from any Content
• Use any Content for commercial purposes, resale, or to create competing products or services
• Remove or alter any copyright, trademark, or proprietary notices

Violation of intellectual property rights may result in immediate termination of access, legal action, and claims for damages.

8. Community & Conduct

When participating in MYTM community spaces (including but not limited to Discord, group calls, forums, or any other platform), you agree to:

• Treat all members and staff with respect
• Not share financial advice, specific trade signals, or encourage others to make specific trades
• Not post illegal, harmful, threatening, abusive, defamatory, or objectionable content
• Not spam, solicit, or promote external products or services without permission
• Not impersonate any person or misrepresent your affiliation
• Not share your account access or others’ private information

MYTM reserves the right to remove content and suspend or terminate access for any user who violates these conduct standards, at its sole discretion and without refund.

9. Disclaimer of Warranties

MYTM does not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. MYTM does not warrant that any Content will produce any particular financial result.

10. Limitation of Liability

To the maximum extent permitted by applicable law, MYTM, Telos Holdings Pty Ltd, Patrick Bailouni, and all associated parties shall not be liable for any:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or trading capital
• Trading losses resulting from the use or interpretation of any Content
• Damages arising from your reliance on any information provided by MYTM
• Damages arising from unauthorised access to or alteration of your account
• Any other damages arising from or related to your use of the Services

In no event shall MYTM’s total aggregate liability exceed the amount you paid to MYTM for the specific product or Service giving rise to the claim, or AUD $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, MYTM’s liability is limited to the fullest extent permitted by law. Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded by agreement.

11. Indemnification

You agree to indemnify, defend, and hold harmless MYTM and all associated parties from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to your use of the Services, your trading activities, your breach of these Terms, or your violation of any law or third-party rights.

12. Assumption of Risk

By using any MYTM Service, you expressly acknowledge and assume the inherent risks of trading and investing in financial markets, including the risk of substantial financial loss. You confirm that you are participating voluntarily and that MYTM bears no responsibility for your trading decisions or their outcomes.

13. Termination

MYTM may terminate or suspend your access to the Services at any time, for any reason, including but not limited to breach of these Terms, harmful conduct, suspected fraud, or at MYTM’s sole discretion. Upon termination, your right to use the Services ceases immediately.

Sections relating to intellectual property, limitation of liability, indemnification, assumption of risk, and governing law survive termination.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia, for the resolution of any disputes arising from or related to these Terms or your use of the Services.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with the Privacy Policy, Earnings & Financial Disclaimer, and Refund Policy, constitute the entire agreement between you and MYTM regarding the use of the Services and supersede all prior agreements, representations, and understandings.

17. Modifications

MYTM reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.
